IV. Company registration and employment phase

What type of legal entity is the best to register for my business?
The type of legal entity that will be chosen when registering the business which is part of the Self-employment Programme will be established in coordination with the involved mentors in the process of trainings.
May I employ also another person supported by the Programme?
Yes. Based on the needs of the specific business the candidates are given an opportunity to apply for additional (max.) two employees. Those with approved additional employees will receive support in the amount of MKD 92,000 per person for procuring equipment and/or materials.
If additional employees are approved within the programme when I’ll be able to employ them?
Within 30 days after signing the Agreement you have an obligation to employ the approved additional persons.
Should the additionally employed person also be a person with disabilities?
No.
When would I have to start paying contributions?
This will depend on the type of the registered legal entity.
Should the grant money be repaid?
• The participants in the Programme that will acquire the right to use the grant funds will also acquire certain rights and obligations. Some of the obligations of the grant beneficiaries are stated below:
If the person – grant beneficiary stops working (his/her employment is terminated) before the end of the first (1) that is the second (2) year from the date of business’ registration except in case of death or permanent disability or the employment is only terminated, but s/he is not replaced by another person, the person in question – the founder of the company is obligated within 12 months time to repay:
− 80% of the funds used for procuring equipment and/or materials, and
− 60% of the funds used for procuring equipment and/or materials if s/he stops working (his/her employment is terminated) before the end of the second year from the date of business’ registration.

• The registered business that is supported with this Programme if after the end of the first six (6) months from the business’ registration fails to make any financial transactions (i.e. to pay the gross salary) through the Public Revenue Office, the Employment Service Agency of the Republic of Macedonia sends a warning letter to the company stating inactivity. If after the end of three months since the day the warning is delivered the person – the grant beneficiary still fails to make any financial transactions to the Public Revenue Office, the Employment Service Agency of the Republic of Macedonia initiates a procedure for repayment of the grant money.

What if I decide to give up before or after the business’ registration?
In case of failure to respect or perform the obligations from the Programme and the Agreement the beneficiaries are subject to contractual sanctions:

• The persons who in the course of the project cycle submit business plans, which are successfully evaluated, but they decide not to participate further, before the grant funds are used are not subject to any sanctions.

• If the person – the grant beneficiary stops working (his/her employment is terminated) before the end of the first (1) that is the second (2) year from the date of business’ registration and s/he is not replaced by another person from the same target group, the founder of the company is obligated within 12 months time to repay:
− 80% of the funds used for procuring the equipment and/or the materials, or
− 60% of the funds used for procuring the equipment and/or the materials if s/he stops working (his/her employment is terminated) before the end of the second year from the date of business’ registration.

If I’m offered another job, could I accept it and employ another person for my position?
Yes, but you should immediately employ another person from the same target group. The newly employed person takes over the rights and the obligations for the company as its manager as provisioned in the Agreement.
Could you help me acquire all the necessary permits, decisions and certificates that are necessary for the registration of the legal entity in the Central Registrar of Republic of Macedonia?
The candidate is responsible for the acquisition of documents (permits, decisions, certificates, licences, etc.) that are necessary for the registration of some of the legal entities, but it is done with the support of the mentor.
